Abstract

ABSTRACT Marriage is a legal act that will have legal consequences, namely the existence of rights and obligations. These rights and obligations usually occur between parents and children. One of the obligations that must be fulfilled is the obligation of a child to care for and provide for the parents. The obligation of children to parents is regulated in positive law through Law No.1 of 1974 concerning Marriage, Article 46 paragraph 2 and Islamic Law. The focus of this research is how to analyze children's obligations towards parents who live in nursing homes and what are the factor of children leaving their parents in the nursing home. This research is a type of Sociological legal research and is descriptive analytical in nature. This research will be conducted by interviewing elderly parents who are entrusted by their children at UPT PSTW Khusnul Khotimah Pekanbaru. For data collection obtained from observations and interviews. Sources of data used in this study came from primary and secondary data. Data analysis using observation methods obtained from interviews and draw conclusions in a deductive way. The results of the research on the analysis of children's obligations towards parents who live in nursing homes are that according to the Marriage Law and Islamic law it requires a child to care for and provide a living to both parents. But if there are children who leave their parents in a nursing home, the child does not fulfill their obligations as stated in positive law and Islamic law. Because basically the obligations of children towards their parents must be fulfilled directly by their children. The factor for the children entrusting their parents to the nursing home are: First, because the children are busy with work. Second, because of economic factors and limited housing. All children who leave their parents in nursing homes never visit their parents.
