Abstract

Abstract The implementation of the Agreement on Agricultural Land Tenure with Liens is a serious problem in the economy of the state community, this is because if the implementation of control over agricultural land with Lien rights is allowed to exceed the maximum time limit, it will further increase social inequality in the community, and for the economic community. Weak about difficulties in improving the economy, which should be given special attention to the weak economic community by the State, in order to avoid feudal control of land like in the colonial period The main problem in this research is how the implementation of control over agricultural land with liens based on article 7 of Law Number 56 of 1960 concerning the Determination of Agricultural Land Areas in Junjung Sirih District, Solok Regency and what are the inhibiting factors for the implementation of control of agricultural land with liens according to the Law Law Number 56 of 1960 concerning Agricultural Land Boundary Areas. However. This type of research is an empirical type, in terms of its descriptive analytical nature, while the data collection tool in this research is through interviews and observations regarding the implementation of Article 7 of Law Number 56 Prp of 1960 concerning Pawn in the research location, namely the District Uphold the Sirih of Solok Regency. The implementation of the agricultural land tenure agreement with a lien in accordance with Article 7 of Law Number 56 of 1960 concerning Pawning involves several Parties to the pawn agreement, namely the Pawn Planner, Pawn Recipient and local Customary Holders namely the Chairperson of the Nagari Adat Kerapatan (KAN), the pawning agreement has exceeded the maximum limit as mandated in Article 7 of Law Number 56 Prp of 1960 concerning Pawn, namely 7 (seven) Years and makes gold as borrowing and redemption money, while the price of gold has increased every year, while that is an obstacle in its implementation. The Pawn Agreement according to the existing regulations is due to a lack of legal knowledge and makes customary law the basis for implementing pawning of agricultural land, and there are other inhibiting factors that hinder the implementation of the pawning agreement in accordance with Article 7 of Law Number 56 of 1960 concerning Pawn.
