Abstract

For the notary who is older then the protocol of the notary will be passed on to the official while the notary by the notary heir. The temporary notary official then provided the notary protocol including giving the MPD a maximum of 60 days since his death. However, the provisions of the statute clearly have a meaning that is not the same as the practice at hand. Notary guardians or notary families do not perform the obligations set forth in article 35 of the Act. Few heirs or families of the Notary have not fulfilled their obligations when it comes to protocol. The formulations of the problems in this research are: (a) How is the application of article 35 of the notary office law in relation to the obligation to submit the protocol for notaries who died in Pekanbaru city? (b) What are the obstacles faced in the application of article 35 of the notary office law in relation to the obligation to submit the protocol for notaries who have passed away in Pekanbaru city? This type of research is based on observational research which is a direct study of the field by conducting interviews to obtain complete data. The nature of this study is descriptive, explaining in full detail the application of Article 35 of the Notary Department Act in relation to the surprise submission of a notary protocol that died in the city of Pekanbaru The result of this research is that the application of articles 35 paragraphs (1), (2), (3), (4) and (5) of the notary department's law regarding the submission of the deceased notary protocol in Pekanbaru City has not been as expected and mandated. by Law, because of the family or heirs of the notary concerned it did not inform the Municipal Assembly (MPD) of the City of Pekanbaru. The family or heirs of the notary concerned do not perform the duties as mandated by the Act. Obstacles to the submission of the deceased notary protocol in the city of Pekanbaru are the family or heirs of the notary concerned notifying the Pekanbaru District Supervisory Council (MPD) of the notary deceased, ignorance and misunderstanding or misunderstanding of family or heirs against the protocol of the notary and the District Supervisory Council (MPD) of the city of Pekanbaru have difficulty finding the heirs or relatives of the deceased notary.
