Abstract

ABSTRACT The tendency of some companies to make their work easier with a certain time work agreement (PKWT) system at this time is generally motivated by the company's strategy to make production cost efficiency (cost of production). By using this PKWT system, the company tries to save expenses in financing the human resources (HR) working in the company concerned. Specific Time Work Agreement (PKWT) according to its understanding based on KEPMEN No. 100 of 2004 is a worker/labor agreement with an entrepreneur to establish a working relationship for a certain time or for certain workers. But in its implementation, it is not uncommon to find violations that are not in accordance with Law no. 13 of 2003 concerning Manpower, both violations of the type of work as well as the rights and obligations of workers/ laborers. The main problem in this research is how to implement a certain time work agreement at PT. Berkah Usaha Syariah in providing legal protection for workers, and what are the obstacles to not implementing a Specific Time Work Agreement (PKWT) in accordance with Law Number 13 of 2003 concerning Manpower. The research method used is a type of observational research, namely research that observes and describes things that occur, both social and natural phenomena, within a certain time span, and researchers cannot control these phenomena. In obtaining data, the authors used data collection methods in the form of interviews and directly to the field. The results of the author's research are the implementation of a Specific Time Work Agreement at PT. Berkah Usaha Sharia is still not in accordance with Article 59 paragraphs (1) and (2) of the Manpower Law. After further review, the contents of the PKWT agreed between PT. Blessings of Sharia Business with workers/labor are not in accordance with the provisions of the Manpower Law, including Articles 88 and 89 of the Manpower Law, where the wages received are not in accordance with the Pekanbaru UMK and Article 58 (1) of the Manpower Law due to a probationary period for workers/laborers PKWT. The problem of not implementing PKWT at PT. Blessings for Sharia Business are caused by 3 things, namely: obstacles related to regulations, obstacles related to Work Agreements, and obstacles related to Supervision.
