Abstract
ABSTRACT The number of traffic accidents involving children and resulting in the loss of one's life or property creates unrest for road users, one of the contributing factors is the lack of supervision by parents and those responsible for giving permission to drive four-wheeled or two-wheeled vehicles without having a driver's license. Seeing the crime committed by the child, accountability for the crime committed by the child is needed, because basically the child should not be punished, but carried out with diversion efforts, so that the child does not become traumatized by the crime he committed. The main problems in this study are first, how is the implementation of diversion against children who commit traffic crimes at the Indragiri Hulu Police in 2018 and what are the obstacles in implementing diversion for children who commit traffic crimes at the Indragiri Hulu Police in 2018. The author uses the research method of observational research, to answer the formulation of the main problem above, namely by means of a direct survey to the research location. To obtain the necessary data, the authors also use data collection tools in the form of interviews and questionnaires. The nature of this research is descriptive which means this research provides a clear and detailed picture. Implementation of Diversion Against Children who commit Traffic Crimes at the Indragiri Hulu Police Station in 2018 that investigators must consider the category of crime committed, the age of the child, the results of community research from the Fathers, and the support of the family and community environment so that in solving traffic crime cases where the perpetrator is a child, this can be realized by diversion as mandated by the Juvenile Criminal Justice System Act which aims to achieve peace between victims and children, by resolving children's cases outside the judicial process, thereby preventing children from being deprived of independence, encouraging the community to participate and inculcating sense of responsibility to children. Obstacles in the Implementation of Diversion Against Children who commit Traffic Crimes at the Indragiri Hulu Police in 2018 include Human Resources (HR) related to the Indragiri Hulu Police Personnel in handling child cases at the Indragiri Hulu Police. in conflict with the law in order to reach an agreement, Limited facilities and adequate infrastructure in the Diversion process, The amount of compensation requested by the victim to the perpetrator is not in accordance with the economic capacity of the perpetrator and the perpetrator does not feel guilty for the accident that occurred.
