Abstract

The crime of decency against children in general causes unrest in the community and can also affect the growth process of the child due to experiencing enormous trauma. The case of decency towards children has always increased significantly lately. One of the cases of decency in which a victim child is a criminal act of incest committed by a biological father against his child. Sexual intercourse in this study is a criminal offense as stated in Law No. 35 of 2014 concerning Child Protection in article 76D, namely that every person is prohibited from committing violence or threat of violence forcing the child to have intercourse with him or with others. The main problem in this study is what are the factors causing the occurrence of incest by a biological father against his child, what is the modus operandi of incest crime by a natural father against his child. This research method is an observational research by means of a survey that is conducting research directly to the research location by using data collection tools in the form of interviews. Meanwhile, when viewed from its nature, this research is descriptive in nature, which means describing a carefully examined fact about the causes of incest crime by biological parents against their children and the modus operandi of incest criminal acts by biological parents against their children. From the results of the author's research, the factors causing the occurrence of incest by a biological father against his child are based on: the factor of husband and wife relationship that is not in harmonic, so that the husband's sexual needs cannot be fulfilled by his wife. so that the offender is not able to control his desires and with low faith in the offender as well as the opportunity so that incest occurs by the biological father of his child. The modus operandi carried out by the perpetrators in incest by a biological father against his child is by asking for a massage then forcing the victim to have intercourse with him.
