Abstract
ABSTRACT The construction of the Grand Mosque of Riau Province is a Multi years project that began work on the foundation in 2017. The total physical budget used was around Rp. 104 billion. The project was carried out by PT. Tri Jaya Permai. Which is stated in the agreement letter / contract number: 645.8/KONTRAK-ADD-FSK.MSJD-RAYA/PUPR- PB/XII/2019/04.B TANGGAL 26 SEPTEMBER 2019. Based on the above background, the problem that will be answered is how the implementation of the principle of good faith between the Public Works & Spatial Planning Office and PT. Tri Jaya Permai in the Physical Construction Work Contract for the Construction of the Grand Mosque of Riau Province and the fulfillment or failure of the Good Faith Principle in implementing the agreement. This type of research is observational reseach by way of survey, namely research that takes data directly from the population / respondents by conducting interviews as a data collection tool, then from the data taken processing so that conclusions are obtained by deductive methods. Whereas if seen from its nature, this research is descriptive, namely research that explains in the form of clear and detailed sentences about the application of the principle of good faith in physical construction work on the construction of the Great Mosque of Riau Province. Based on the research results, it appears that good faith leads to two meanings, namely good faith which means honesty and good faith which means appropriateness or justice. Good faith in a construction work contract has three functions, namely: a. All contracts must be interpreted in good faith; b. Good faith has a function that adds to the contractual obligations of the parties; c. good faith has a function that limits and eliminates a contractual obligation of the parties.
