Abstract

Customary rights as rights inherent in customary law communities, which have been recognized in the 1945 Constitution. In the Alagagation of Tanjung Alai there is a wealth of river resources as the wealth of the nagari. This river resource is not only utilized by the people in Tanjung Alai Kenagarian but also is used by the government, but the government does not provide benefits to the community directly, instead it harms the people in Tanjung Alai Kenagarian. The main problem in this study is the implementation of the use of river resources as objects of customary rights in the Kenagarian Tanjung Alai Subdistrict Lubuk Siking Subdistrict Pasaman Regency and the management of river resources in the Kenagarian Tanjung Alai Subdistrict Lubuk Siking Subdistrict Pasaman Regency. The method in this study uses observational research and descriptive analysis. The main data in this study are primary data using the interview method, secondary data are only as supporting data, obtained by conducting a document study. The analysis links with statutory regulations. The results showed that the implementation of the use of river resources in Kenagarian Tanjung Alai was utilized directly by the people in Kenagarian Tanjung Alai for their daily needs. The management of river resources in Tanjung Alai Kenagarian, which is indirectly controlled by the government by collecting fees every month, is something that deviates from the customary provisions in Tanjung Alai, because the people there are indigenous people in the Tanjung Alai Kenagarian who have rights to the river's resources.
