Abstract

Every citizen has the right to live in physical and spiritual prosperity, to live in a proper and healthy manner. The house is a basic need in society which is a place for rest and family gathering. Along with the growing population of Indonesia's population, the housing problem has become a problem for the government because of the state's alignment with low-income people. Therefore, the government and developers provide an alternative related to this problem, namely providing Home Ownership Loans. This research has 2 problem formulations, namely: how is the process of taking over subsidized housing according to the regulation of the Minister of public works and public housing number 20/PRT/M/2014 and whether the takeover is in accordance with the regulation of the minister of public works and public housing number 20/PRT /M/2014. The method used to answer the problems mentioned above is empirical legal research by conducting research on subsidized housing in the Kampar district. The data used in this thesis were obtained through interviews, observations, laws and regulat ions, books, journals, theses, and expert opinions. The entire data that has been obtained is then analyzed qualitatively, then concluded through the inductive method. Based on the results of the study, it was found that the juridical analysis of the take over of subsidized housing based on the regulation of the Minister of public works and public housing number 20/PRT/2014 in the Kampar area had been implemented by the Bank but not by the customer and also by a notary outside Bank because in the regulation of subsidized mortgage housing. The transfer of ownership may not be carried out if it has not reached the 5-year occupancy period. However, in the field, customers still make the transfer of home ownership without the knowledge of many parties and use a power of attorney to sell from a notary. This is due to the large number of imbalances in policy implementation, resulting in a mismatch of a regulatory policy in the field.
