Abstract

One Clan’s Marriage still occur today despite heavy sanctions, as in the indigenous people residing in Parbubu Pea Village, Tarutung District, North Tapanuli Regency. In this village there are still couples who marry one clan, even though it is already known in the Batak Toba custom that one clan's marriage is strictly prohibited because it violates the norm that is still held in high esteem until now. But it is still done and violated, and also no longer remembers the oath that was said by the ancestors. For that the authors conducted research with a problem about Factors Causing the Occurrence of One Clan's Marriage in the Environment of the Toba Batak Customary Community in Parbubu Pea Village, Tarutung District, North Tapanuli Regency, and Settlement and Impact and Sanctions of the existence of One Clan's Marriage in the Environment of the Toba Batak Customary Law Society Specifically in Parbubu Pea Village, Tarutung District, North Tapanuli Regency. While observational research methods, namely by means of surveys, where the authors directly come to location of research to obtain the data needed by using data collection tools in the form of interviews. The nature of this research is descriptive which means this research provides a clear and detailed picture. As for the result of the discussion are Factors causing marriages of a one clan in the Batak Toba indigenous community in Parbubu Pea Village, Tarutung District, North Tapanuli Regency include education, religious factors and also social and environmental factors. But besides these three factors, there are factors that cannot be denied by married couples one clan, that is the age factor. As for the settlement and impact and also sanctions of the marriage of one clan in the Batak Toba traditional law community, the Parbubu Pea village settlement is done by means of deliberation between the traditional elders and community groups by giving customary sanctions that are expelling them from the village and giving punishment for not being able to attend events in the Batak custom. The impact of the marriage of one clan to the environment is that parents are increasingly possessive of children in their relationships so that they do not make a mistake.
