Abstract

Circulation of smuggled imported used clothes in the Regency Indragiri Hilir cannot be separated from the role of distributors of imported used clothing, Imported used clothes that are traded by retail traders are bought and sold traders through agents who sell the imported used clothes in the form of ball press. The agent is the party who receives the goods from smugglers of imported used clothing (Ballpress) on a large scale later stored in warehouses for resale to traders. Clothes ex-import is a product that is prohibited from importing which has been regulated by Law Number 7 of 2014 concerning Trade and Regulation Minister of Trade Number 18 of 2021 concerning Prohibited Goods Export And Import Prohibited Goods. The phenomenon of the rise of clothing circulation former imports in Indragiri Hilir Regency can be seen from the rampant trade imported used clothing in the Indragiri Hilir Regency, namely in Kota Tembilahan. In the city of Tembilahan, the trade of imported used clothes is becoming a thing which is commonplace and we can find it easily in various places ranging from roadside stalls such as squat markets, used clothing store houses to traditional shopping centers such as teak wood markets and shopping malls other used clothes. Based on the above background, the following are the main problems What are the factors? Causes of the Crime of Withholding Used Clothes Smuggling in the Legal Territory of Indragiri Hilir Regency and How Efforts to Overcome the Crime of Withholding Imported Used Clothing Smuggling in the jurisdiction of Indragiri Hilir Regency. The method used in this research is observational research or by means of a survey, namely research that takes samples from a population and use interviews as a data collection tool subject matter, while the nature of this research is descriptive analysis, research location This is in Indragiri Hilir Regency. The results of this study that the Factors Causing the Occurrence of The Criminalization of Smuggling Used Clothing Imports, namely Factors Environment, Economic Factors and Law Enforcement Factors. High interest the community in buying imported used clothes and trading secondhand clothes imports which are considered quite profitable, this also causes a number of parties import used clothing on a large scale a lot and also this is what causes the removal of imported used clothes occur. Efforts to Deal with Smuggling Imported Clothing in Indonesia The Legal Territory of Indragiri Hilir Regency is carried out 1) Pre-emptively Continue conduct socialization to entrepreneurs of imported used clothing. 2) Preventive prevent the entry of imported used clothing into the Indragiri Hilir area as well as dig up information to find out who the agent/distributor of imported used clothing is the. 3) Repressive action takes action and arrests as well as search of warehouses or places known to store used clothes import in the form of ballpress.
