Abstract

The provision of credit by the Village Owned Enterprise (Bumdes) savings and loan business is inseparable from the existence of arrears in installments or bad loans made by customers. This is due to the failure of the debtor to fulfill its obligations to pay the principal installments along with the interest agreed by both parties in the credit agreement. The main problem of the research is how to implement a loan agreement from village-owned enterprises (BUMDES) Kumu Jaya Bersama to small entrepreneurs in Rambah Hilir village, Rokan Hulu district, and how to resolve disputes over rights and obligations in the loan agreement from village-owned enterprises (BUMDes). Kumu Jaya Together with Small Entrepreneurs in Rambah Hilir Village, Rokan Hulu Regency. The approach used in this research is empirical juridical or sociological legal research. while its descriptive nature, which aims to provide a detailed and clear description of the agreement made by the Kumu Jaya Village-Owned Enterprise (BUMDES) together with the Small Entrepreneur of Rambah Hilir Village, Rokan Hulu Regency and find out what legal remedies can be taken for the problem. . The results showed that the implementation of the loan agreement from the Village Owned Enterprise (BUMDES) Kumu Jaya Bersama to Small Entrepreneurs in Rambah Hilir Village, Rokan Hulu Regency was not running optimally because there were still problems caused by not conducting a survey of prospective borrowers which aimed to determine the eligibility of customers. to accept loans, especially to old customers who show a character of untrustworthy use, causing these customers to be in arrears in payments even though Bumdes has given full trust to customers. Efforts to resolve disputes over rights and obligations in the loan agreement from Kumu Jaya Bersama Village-Owned Enterprises (BUMDES) to Small Entrepreneurs in Rambah Hilir Village, Rokan Hulu Regency are not carried out in accordance with the agreement where when the customer is 3 months late in payment, the Bumdes will hand it over to The District Attorney's Office, but Bumdes only goes to the customer to find a solution and provides payment relief for half of the initial installment but the payment period is increased until the customer pays off his obligations.
