Abstract

In Islam, there are legal institutions or institutions that aim to for the general welfare. The institution is a waqf. In Indonesia almost All mosques are waqf land. In implementation in the field, it is still waqf problems were found. One of them is land transfer Transfer of Waqf Assets at An-Najah Mosque. The formulation of the problem in this thesis is: First, how? the implementation of the transfer of waqf property at the An-Najah mosque in terms of Law number 41 of 2004 concerning waqf in Bukit District Raya Pekanbaru ?Secondly, what are the inhibiting factors and factors? support in the transfer of waqf assets to the An-Najah mosque, District Bukit Raya Pekanbaru ?And third, what is the position of the transfer of property? waqf at the An-Najah Mosque in terms of law number 41 of 2004 about waqf in Bukit Raya Pekanbaru district? The method used in this research is this research is seen of its kind belongs to the normative-empirical type of research method that using secondary data (library) and then supported by data primary, which is based on direct field research by conducting observation, interviews, and documentation. The results of the study stated that the implementation of the transfer of property waqf at the An-Najah Mosque in terms of law number 41 of 2004 regarding waqf in Bukit Raya Pekanbaru District is in accordance with The applicable laws and regulations. The rollover requirements are already fulfilled and the implementation of the exchange of waqf land according to the existing procedures in Law No. 41 of 204, PP No. 42 of 2006 and PP No. 25 of 2018. However, when the exchange of waqf land is carried out, the transfer of property waqf at the An-Najah Mosque is not on target, the factors that become inhibitors and supporters in the transfer of waqf property to the mosque An-Najah, Bukit Raya Pekanbaru District, namely: Lack of Completeness Administrative Files, Lack of Proficiency in Waqf Management Nadzir, Delays in waqf property, Public Awareness and Nadzir Regarding Social and supporting functions are the Land of Strict and Fair Regulations, Permits Easier Transfer of Waqf Land assets, Land Availability Substitute, the position of the transfer of waqf property at the An-Najah Mosque in terms of law number 41 of 2004 concerning waqf in Subdistrict Bukit Raya Pekanbaru Changes in waqf property can be done as long as certain conditions are met and by submitting reasons as determined by applicable law.
