Abstract

Constitutional Court states that Article 2 paragraph (1) of the Marriage Law is very clear with the sound "Marriage is valid, if it is carried out according to each law" religion and her trust that." So that in aspect marriage permanent must based on the provisions of their respective religions and positive laws that set it up. The formulation of this problem is, first, how do you consider Constitutional Court in the decision Number 68/PUU-XII/2014? Second, what are the consequences Constitutional Court Decision Number 68/PUU-XII/2014 against Problems with Interfaith Marriages for Indonesian Citizens? This research is a normative legal research (legal research), namely researching or reviewing books or literature and writings related to the subject matter being researched. The process of data analysis in this study the author uses analytical descriptive method, which describes the problems found from the data related to the research material which will be analyzed further. The conclusion of this study, that the considerations of the Constitutional Court states that as a country based on the Almighty God, then actions or actions carried out by citizens have a strong relationship closely related to religion, therefore the Constitutional Court rejected the petition of the Applicant. According to the Constitutional Court Article 2 paragraph (1) of the Law Marriage has been very clear with the sound "Marriage is valid, if it is done" according to the law of each religion and belief." the law of the Constitutional Court's decision is to affirm that religious law must be a measure in determining whether a marriage is legal or not, including not the validity of interfaith marriages.
