Abstract

Pregnant marriage or marriage that occurs as a result of an extramarital relationship that causes a woman to become pregnant is something that can often be said to happen. This happens because each of the men and women have a relationship outside of marriage, this happens due to the association which at this time can be said to be promiscuous which makes young people and women free to do anything and do not think about what the consequences of their actions will be. However, this research will focus on how to carry out pregnant marriages and what are the consequences of customary law if a pregnant marriage occurs. Based on the background of the problem, the background in this study is how to arrange marriage according to customary law in Kenagarian Taram, Harau District, Lima Puluh Kota Regency, how the implementation of pregnant marriage "Kawin Tapanjek in Lansek Nan Masak" in Kenagarian Taram, Harau District, Lima Puluh Kota Regency , and What are the consequences of customary law on the occurrence of pregnant marriages in Kenagarian Taram, Harau District, Lima Puluh Kota Regency. The research method used is the Sociological research method, which is research that goes directly to the field. This research was conducted in Kenagarian Taram, Harau District, Lima Puluh Kota Regency. From this research, it can be seen that the marriage rules in Kenagarian Taram are the result of a joint decision that must be obeyed because they are related to the norms that apply in the social environment where the rules start from a community habit which they think is useful and then applied as their customary law rules. of course these rules do not conflict with religious norms and applicable rules. as well as the customary marriage arrangements that apply in Kenagarian Taram which are regulated according to Minangkabau customary law that uses a matrilineal system, for example the rules where weddings are held based on customary rules that apply in Kenagarian Taram. In the implementation of marriage, it will be different from the implementation of marriage in general, this marriage will be carried out in a closed manner and does not use any ceremony which aims to cover the disgrace of the family. The consequences of customary law if a pregnant marriage occurs in the form of sanctions that will be given by the office of the Nagari Adat Density which later will be in the form of a fine, being excommunicated for 100 days, and apologizing to Niniak Mamak Nan Duo Puluah Ampek, and for the position of the child will later be it is recognized by custom if the child's parents have completed the sanctions given, but still, later on, the father will not be able to marry him, as is the case with Islamic religious rules. After that, if the child is a descendant of Niniak Mamak, the child will not be able to continue the title, because a child born of adultery cannot be appointed as a Niniak Mamak.
