Abstract

Regarding the implementation of law number 16 of 2019 concerning marriage in the pasir pengaraian religious court, where this rule has been enforced, causing many cases of marriage dispensation applications that have been submitted to the pasir pengaraian religious court which is what causes underage marriages . The judge's consideration factor in granting the marriage dispensation is looking at the completeness of the administrative requirements and in terms of the benefit for both parties. The formulation of the problem in this research that is first, how the implementation of law number 16 of 2019 concerning marriage on the application for marriage dispensation at the pasir pengaraian religious court. Second what are the consideration factors of the pasir pengaraian religious court judges in granting the marriage dispensation application after the enactment of law number 16 of 2019 concerning marriage. This research is classified as empirical sociological research type, where the author goes directly to the field to get some data which data is used to obtain a number of information related to this research. While the nature of the research used is descriptive analysis From the results of the research that the author found from this study, it was in relation to the implementation of law number 16 of 2019 concerning marriage that the Pasir Pengaraian Religious Court had implemented the rule, in which the age limit for marriage for both men and women was 19 years old, this is caused many cases of marriage dispensation in the Pasir Pengaraian Religious Court. While the consideration factor for the judge of Pasir Pengaraian in submitting the application for a marriage dispensation namely fulfilling the administrative requirements of the marriage dispensation and seeing whether or not there is a prohibition on marriage for both parties.
