Abstract

ABSTRACT In the course of human life, of course, it always begins with birth and ends with death, which will then cause certain legal consequences, namely regarding the inheritance left by the testator. The Batak Mandailing indigenous people in the Village of Rambah Tengah Barat, Rokan Hulu Regency adhere to a patrilineal kinship system, namely the withdrawal of lineage taken from the lineage of the father or male. So that in the case of inheritance, the only son who has the right to the inheritance left by the testator is the son. The main problems examined in research on the inheritance system in the Mandailing Batak custom, the implementation of the distribution of inheritance in the Mandailing Batak custom in Rambah Tengah Barat Village and developments in the distribution of inheritance in the Mandailing Batak custom in the Rambah Tengah Barat Village. The research method used is the empirical juridical method. This research is descriptive in nature, and the data collection tool in this study is through interviews regarding the implementation of the distribution of the Batak Mandailing traditional heritage in the village of Rambah Tengah Barat, Rokan Hulu Regency. The results of the study indicate that the inheritance system in the Mandailing Batak customary law community is the inheritance system or individual inheritance. The implementation of the distribution of inheritance in the Batak Mandiling custom in Rambah Tengah Barat Village is divided into two, namely the implementation of inheritance before the heir dies and after the heir dies. The development that occurred in the distribution of the Batak Mandiling customary inheritance in the Village of Rambah Tengah Barat, namely a daughter demanded her rights to the inheritance left by the heir and demanded more inheritance than what the heir had left in a will or grant for her.
