Abstract

This study discusses the application of restorative justice to traffic crimes committed by minors with their negligence resulting in minor injuries in the jurisdiction of the Rokan Hulu Police. The selection of this title is motivated by the mechanism for resolving cases of traffic accidents according to the traffic law and road transportation, if it meets the criminal elements, a legal process must be carried out in accordance with the criminal justice system which includes: investigation, prosecution, examination and settlement as well as submission of the case. In practice, it can be seen that a number of traffic accident cases were not resolved through the courts but were settled amicably by the parties. This study aims to find out how the application of restorative justice to traffic crimes committed by minors with their negligence resulted in minor injuries in the jurisdiction of the Rokan Hulu Police, what are the successful and unsuccessful obstacles to the application of restorative justice to traffic crimes committed by minors with their negligence resulted in minor injuries in the jurisdiction of the Rokan Hulu Police. This type of research is sociological legal research, namely research by survey method, the type of data used in this research is sourced from primary data and secondary data, primary data is obtained from the results of field research while secondary data is obtained from the results of library research. The nature of this research is descriptive, that is, research conducted by conducting interviews with several respondents, namely the invisibility of the Rokan Hulu Police, Head of Laka unit, children as perpetrators, victims, families of perpetrators, victims and community leaders, analysis of the data used in the study, this is a qualitative data analysis. From the results that the authors get, the application of restorative justice is resolved in a familial way by applying ADR (Alternative Dispute Resolution) by involving the parties involved starting from the perpetrator, the victim, the parents of the perpetrator, the victim, and community leaders, stated in a peace agreement signed by the parties in resolving it by way of Alternative Dispute Resolution, while the obstacles to successful and unsuccessful implementation of this restorative justice are the difficulty of reaching an agreement between the perpetrator and the victim and the intervention of a third party during the peace process.
