Abstract

The formulation of the problem in this study is how the process of proof in a criminal case at the Pasir Pengaraian District Court no. 415/Pidsus/2020/PN Prp and How do judges consider in deciding Narcotics Crime Cases Outside the Prosecutor's Demand, Pasir Pengaraian District Court No. 415/Pid.Sus/2020/PN Prp The type of research used is normative legal research using primary legal materials, namely the District Court case file Number 415/Pid.Sus/2020/PN Prp. Meanwhile, from the nature of the research, it uses descriptive research, which provides an overview of the evidence and judges' considerations in deciding narcotics crime cases outside the demands of the Public Prosecutor for Case No. 415/Pid.Sus/2020/PN PRP. The results of the research and discussion in this study are the process of proving narcotics crimes in Case Number 415/Pid.Sus/2020/PN Prp. The public prosecutor charged the defendant based on valid evidence. There were 3 witnesses presented by the public prosecutor. Defendant's statement that it is true that the Defendant acknowledged the evidence presented in the trial and the Minutes of Criminal Laboratory Examination No. LAB: 0679/NNF/2020. The legal considerations of the panel of judges in deciding the narcotics crime case in case number 415/Pid.Sus/2020/PN Prp with the primary indictment violating Article 114 paragraph (1) and the subsidiary indictment violating Article 112 paragraph (1) of the Republic of Indonesia Law Number 35 years 2009 About Narcotics. The judge's consideration based on the facts of the trial the judge issued a decision taking into account Article 127 paragraph (1) letter a of the RI Law Number 35 of 2009 concerning Narcotics and the Criminal Procedure Code and other relevant laws and regulations.
