Abstract

Most of the Batak Karo people strongly believe that inheritance is very useful for life provisions and for the creation of peace and the sustainability of their clan descendants. Inheritance to the Karo indigenous people is given to boys. So that based on the provisions of Indonesian customary law, this is commonly known as the patrilineal kinship system. The provisions of customary law that are recognized and upheld by the Karo people, especially those who have embraced the Islamic religion, no longer fully implement these customary provisions, because some of the practice is that there are girls who have inherited property from their parents, even though the assets are given in the form of a will or was given before the parents died The main problem of the research is how the implementation of the distribution of inheritance to the Karo Muslim community associations who are monitored in Kandis district, Siak district, and what are the obstacles in the implementation of the distribution of inheritance to the Karo Muslim community associations who are monitored in Kandis District, Siak Regency. While this research method is observational research by means of direct survey research going down to the field to provide accurate data about the relevant objects in the field that is researched and direct complete and in accordance with the details. The results of the author's research, namely the implementation of the distribution of inheritance to the Karo Muslim Community Association who are monitored in Kandis District, Siak Regency, is that there is already a waiver in the Karo customary rules where to carry out the distribution of inheritance, both parents are dead. So that if the death of the male parents does not necessarily mean the assets left behind can be divided as inheritance to the children. Then the waiver of the customary rules is also seen when the custom implies that it is the boy who has the obligation to hold the property of the deceased parent, but in practice there are girls who get inherited property from their parents by giving a will or giving it before their parents die, and Constraints in the Implementation of the Distribution of Inheritance to the Karo Muslim Community Associations Monitoring in Kandis District, Siak Regency is the occurrence of disputes between heirs because when the distribution of inheritance is carried out the daughter has controlled the assets of her parents before her parents died and is not known by the brother -Male even though in the stipulations girls are not entitled to receive an inheritance and there is no agreement between the heirs in the distribution of the inheritance.
