Abstract

The background of this research is that there are still companies that employ employees who work more than 7 (seven) hours a day and 40 (forty) hours 1 (one) week for 6 (six) working days in 1 (one) week or 8 (eight) hours. hours a day, and 40 (forty) hours 1 (one) week for 5 (five) working days in 1 (one) week or working time on weekly rest days and or on official holidays determined by the Government and no overtime pay is provided, so the workers lose their rights. The formulation of the problem is how to implement the overtime pay work agreement between employees and PT Wiradjaja Prima Kencana in Pekanbaru City? Is legal action taken against companies that do not pay compensation for the agreed working hours and provide compensation for the agreed service period at PT Wiradjaja Prima Kencana in Pekanbaru City? The research method used is a type of observational research, namely research that observes and describes things that occur, both social and natural phenomena, within a certain time span, and researchers cannot control these phenomena. In obtaining data, the authors used data collection methods in the form of interviews and direct spaciousness. The results of the study show that the implementation of the overtime pay work agreement between employees and PT Wiradjaja Prima Kencana in Pekanbaru City has not run properly where there are still workers who work on National holidays without being paid overtime wages, so that these workers lose their rights and obligations, and have not been implemented. in accordance with the mandate of the Act with evidence of complaints about overtime wages of former employees of PT Wiradjaja Prima Kencana which were not paid. Legal efforts were made against companies that did not pay compensation for the agreed working hours and provided compensation for the agreed working period at PT Wiradjaja Prima Kencana in Pekanbaru City that based on existing legal rules, workers who have worked overtime but are not given wages overtime by the company, can take several steps or efforts to fight for their rights.
