Abstract

The enforcement of disciplinary regulations for Civil Servants that applies throughout Indonesia, not least in Riau Province, precisely in Kampar Regency, is still encountered by Civil Servants who are not disciplined or violate Government Regulation No. 53 of 2010 and Law No. 5 of 2014 concerning ASN. disciplined in accordance with the violations that have been committed. There are three levels of disciplinary punishment for Civil Servants who commit violations, namely light disciplinary penalties in the form of verbal and written warnings, moderate disciplinary penalties in the form of delays in salary or promotions, and severe disciplinary penalties in the form of demotion to dishonorable discharge as Civil Servants. Based on the above background, the formulation of the problems that will be answered in writing this thesis include: How is the Mechanism of Dismissing Civil Servants With Disrespectful Status Based on Law Number 5 of 2014 concerning State Civil Apparatuses in Kampar Regency in 2019 and What is the Authority of the Regional Government in Dismissal of State Civil Apparatus with Disrespectful Status Based on Law Number 5 of 2014 concerning State Civil Apparatus in Kampar Regency of 2019? This research when viewed from the type of research can be grouped into Sociological Juridical research, meaning that it emphasizes research that aims to obtain legal knowledge empirically by going directly to the field. Sociological Juridical Research is legal research using secondary data as initial data, which is then followed by primary data in the field or on the community, examining the effectiveness of a Ministerial Regulation and research seeking to find a relationship (correlation) between various symptoms or variables, as a data collection tool consisting of study of documents or library materials and interviews (questionnaires). This research is seen from the nature of the research, the authors can be identified as descriptive, meaning that this research provides an overview of a complete, detailed and clear statement. Mechanism of Dismissal of Civil Servants with Disrespectful Status Based on Law Number 5 of 2014 concerning State Civil Apparatus in Kampar Regency of 2019 that regional government has been delegated from the President to Regional Heads as Personnel Guiding Officers based on Law Number 5 of 2014 concerning State Civil Apparatus Based on the principle of decentralization in the context of regional autonomy as stated in the General Elucidation of Law Number 23 of 2014 as amended by Law Number 9 of 2015 concerning Regional Government (UU Pemda) it is stated that the final responsibility for administering Regional Government remains is in the hands of the Central Government, namely the President.
