Abstract

Political parties have the right to participate in the process of selecting members of the legislature in the DPR. Where from each member of the legislature will be one part of the faction members. Basically, the faction performs its functions based on the internal faction members themselves. Each procedure that is designed and compiled is a directive in giving decisions in which the opinions of all members of the DPR are used as the basis for making decisions on every policy that exists in each faction. However, basically this procedure will lead to a consequence, namely that there are differences in each direction from the implementation of the faction to each other. So that this becomes an obstacle in the optimal and effective function of the factions in the DPR, especially the optimization of carrying out the functions, powers and duties of the DPR. Based on the above background, the formulation of the problems that will be answered in writing this thesis include: What is the position and function of the factions in the House of Representatives based on Law Number 17 of 2014 concerning the MPR, DPR, DPD, and DPRD? and what is the ideal position of the factions in the House of Representatives in the Legal Perspective of State Institutions? The writing of this thesis is a normative legal research, which is a research conducted with reference to the legal norms contained in the written legislation as well as the legal norms that exist in society regarding the position and function of the factions in the House of Representatives based on the law. The position and function of factions in the House of Representatives Based on Law Number 17 of 2014 concerning the MPR, DPR, DPD, and DPRD that the existence of factions in the People's Representative Council based on Law Number 17 of 2014 concerning the MPR, DPR, DPD, and DPRD is To optimize the implementation of the functions, powers and duties of the House of Representatives as well as the rights and obligations of members of the House of Representatives as a representative institution in the context of fighting for the interests of the people, the faction is also formed as a forum for members of political parties to gather and equalize differences of various aspirations so that in carrying out their duties , authorities, and functions in representative institutions can run effectively and efficiently. The Faction's Ideal Position in the House of Representatives in the Legal Perspective of State Institutions that the Faction is a forum for assembly of council members who have a big responsibility in accommodating all the aspirations of the people or their constituents.
