Abstract

The problem of recording waqf pledges is a sensitive and very complex problem that can lead to conflicts and conflicts. So that lands with ownership rights must be registered or registered at the Land Office of Indragiri Hulu Regency as well as waqf land. The activity of recording waqf pledges is essentially a joint effort between wakif and nadzir with the offices of the Ministry of Religion and the Land Office of Indragiri Hulu Regency. land and people who are entitled to land by giving a letter in the form of a certificate. In the implementation of recording waqf pledges, many obstacles occur due to several factors, both internal and external factors. This causes a lot of waqf lands that have not received strong legal certainty or authentic evidence and the number of waqf lands that have not been registered, in Rengat Barat District, Indragiri Hulu Regency at the Land Office of Indragiri Hulu Regency. The problem that occurs is the process of recording waqf pledges in West Rengat District, Indragiri Hulu Regency and the supporting factors and inhibiting factors in the implementation of recording waqf pledges in West Rengat District. The method used in this research method when viewed from the type, this research is classified as empirical which includes legal identification (unwritten) with field research. normative law observes how the interactions that occur when the norm system works in society. By using data collection tools in the form of questionnaires, interviews and documentation, while judging by its nature, this research is descriptive in nature to provide an overview of the main research problems. Furthermore, from the results of the author's research, it can be concluded as follows: that the process of recording waqf pledges in the West Rengat sub-district, Indragiri Hulu Regency has not been in accordance with the regulations governing the Law Number 41 of 2004 concerning Waqf. This can be seen from the number of waqf lands that have not been registered with the Office of Religious Affairs. And there are still many people who do not care about the importance of legal certainty for waqf land that has been pledged to be immediately recorded. And there are those who think that registering land requires a difficult process, and this waqf land will not cause problems or disputes in the future because the heirs have approved the land as waqf
