Abstract

The obligation of a husband who is a prisoner in providing for his family is a mandatory thing that we know in Islamic law. The livelihood that the husband has to do is also about the rights of a wife and children. However, if the prisoner does not have the property left behind, it is not obligatory, while the prisoner who has the property left is obligatory and can be said to provide for the family. This is also shown to prison inmates, which are inhabited by inmates' husbands. In this thesis entitled "Implementation of the Obligations of a Husband Who Is a Convict in Supporting a Family in View of Islamic Law (Case Study of Class IIA Pekanbaru)" this issue is discussed, namely: How to carry out the obligations of a husband who is a prisoner in providing for his family and what are the supporting factors and Obstacles in the Implementation of the Obligations of Husbands Who Are Convicts in Supporting the Family. The method used to answer the problems mentioned above is empirical research by conducting field research at the Class IIA Penitentiary Pekanbaru. The data used in this thesis were obtained through interviews, literature books, legal journals, theses, laws, electronic data, and the Big Indonesian Dictionary. The entire data that has been obtained is then analyzed qualitatively, then concluded through the deductive method. The results of the study indicate that the implementation of the obligations of the husband who is a prisoner will continue as usual, the difference is if the husband who has the property left behind does not think about how to earn a living for his family. Meanwhile, husbands who do not have assets left behind must try to survive, namely by carrying out productive development and wives must try hard to replace the role of husbands making a living to support their husbands and children.
