Abstract

On January 1, 2014, PT Askes (Persero) was transformed into Health Social Security Administration. Over a period of more than these two years, BPJS Health in carrying out its program is still not reap optimal results as expected by the Indonesian government as legal entity that organizes the National Health Insurance. The formulation of the problem in this Thesis is; (1) How is protection the law against BPJS Participants in Health Services. (2) How BPJS Health accountability to BPJS Participants for rejection Pekanbaru City Private Hospital in health services. (3) How form of dispute resolution BPJS Health Participants against the rejection of the party Pekanbaru City Private Hospital The objectives to be achieved in this thesis is to provide information for writers and readers regarding rights Indonesian citizens as BPJS Health participants for health insurance given by the State of Indonesia. The research method used in this thesis uses types legal research, juridical normative (legal research) with a problem approach; (1) the Law approach (Statute Approach), and (2) the concept approach (conceptual approach). Legal protection for the people is known in two forms, viz protection that is preventive (prevention of dispute) and repressive protection (dispute resolution). Based on the results research at Awal Bros Hospital and Eka Hospital and BPJS Health Pekanbaru City is known that there are no disputes or individual claims towards BPJS Health services. And if there is a refusal from the House Pekanbaru City Private Hospital against Health BPJS Participants resolved deliberation by the parties, mediasai and finally to the Court. The legal protection referred to in this Thesis is protection legal to BPJS Health participants in this case Hospital Patients. This thesis contains legal protection for participants in BPJS health services, illustrates the accountability of BPJS Health to BPJS participants for refusing private hospitals in Pekanbaru City health services and explain Participant Dispute Resolution Forms BPJS Health Against Rejection of City Private Hospitals.
