Abstract
Customary rights are the authority of indigenous peoples and are regulated in national law based on customary law. Basically it does not prevent the creation of a just and prosperous society. Consequently customary rights according to customary law are still recognized and recognized in the Basic Agrarian Law, so that customary rights and their existence must receive attention and be maintained in indigenous communities. The fact that the customary rights of indigenous peoples are found to be diminished is felt by the Kenegerian Kuok indigenous people, Kuok Subdistrict, Kampar Regency, because of the existence of functional experts by the government and is occupied by indigenous peoples without regard to the applicable customary law. The main problem in this study is how the customary rights and their existence in the tribal community of Sumpu Kenegerian Kuok, Kuok Subdistrict, Kampar Regency and how the use of customary land rights in the Melayu Sumpu Kenegerian Kuok tribal community, Kuok Subdistrict, Kampar Regency. This research is classified as observational research by survey, which means conducting research directly in the field, while its nature is descriptive. Data collection tools used were questionnaires and interviews. Data analysis is grouped according to type and presented in the form of tables and sentence descriptions, then analyzed using applicable laws and opinions of experts. The results of this study are (1) Provisions regarding customary rights in the Kuokarian Kuok, Kuok District, Kampar Regency are binding and certain for the customary law community. But the fact is now starting to fade due to modern thinking so that it leaves the customary values or customary provisions regarding customary rights which are inherited down from his ancestors. The decline was caused by the government and Ninik Mamak / Penghulu / adat holders no longer synergizing to implement adat provisions. These are some of the factors that have caused the fading of the existence of the customary rights of the Melayu Sumpu tribal customary community in Kenegerian Kuok. (2) Utilization of customary land rights by Sumpu Malay tribal people in Kuegarian Kuok, Kuok sub-district, Kampar regency is not implemented properly, because there are provisions in the use of customary land rights which are not implemented as should be based on customary provisions due to lack of attention between Ninik Mamak as The traditional tribal leader with Anak Kamanakan as a member of the customary community and the government resulting in customary rights no longer contributes greatly to the community at present to fulfill their daily lives.
