Abstract

Regulations regarding work agreements have been regulated in the Job Creation Law PP No.35 of 2021 Labor Cluster, one form of work agreement is a Specified Time Work Agreement. PT.Garda Bersatu Nusantara is a service provider company which employs workers with a fixed-time work agreement engaged in the manpower sector. The problem that often occurs in outsourcing is the number of companies that arbitrage workers' rights. This is the case with PT. The United Guard of the Archipelago. In this study, the authors raise a problem that is used as research material, namely How the work system of outsourcing workers in the Security Service Company in the security sector at PT. Garda Bersatu Nusantara Based on Government Regulation Number 35 of 2021 (employment cluster) and How is the wage system for outsourcing workers Security Service Business Entity companies in the security sector at PT.Garda Bersatu Nusantara Based on Government Regulation Number 35 of 2021 (Employment Cluster). Based on the type of this research, namely observational research conducted by means of a survey, the author immediately went to the field to obtain and collect data through interviews. The nature of the research is descriptive, namely to provide information that explains in detail about the implementation of the Outsourcing Worker Work Agreement according to the Job Creation Law, Government Regulation No.35 of 2021 Employment Cluster at Security Service Business Entities (BUJP) in the Security Service Sector at PT. Garda Bersatu Nusantara Pekanbaru The results of the author's research show that the implementation of a certain time work agreement made by PT. Garda Bersatu Nusantara and Security Guard Workers have not been implemented properly. Because it is still contrary to the prevailing laws and regulations, such as working hours that are not in accordance with the prevailing laws and regulations, wages that are below the UMK, there is no overtime pay for workers on a certain time working agreement due to the lack of efficiency of the supervision carried out by the Office of Manpower and Transmigration, resulting in many employers who violate the rules described in the Law on Job Creation PP No.35 of 2021 Employment Cluster.
