Abstract

Gold mining activities without permission seen from the juridical aspect are legitimate. Law number 4 of 2009 concerning minerals and coal only prohibits gold mining ctivities without permits, however, in kuantan singing district especially in cerenti sub-district, there are many gold mining activities without permission. This situation in facts happens a lot, mining activities that do not have such permits have become permanent jobs, so that mining activities carried out as broad as possible without regard to healt will cause environmental damage, loss of livelihood, and the endless threat of this non-renewable natural wealth. Just imagine if dredging and retrieval is continuously carried out will further damage the health of the local populations. Departing from the existing problems, the problems raised in this paper are about how law enforcement efforts against perpetrators of gold mining, without permits in cerenti sub-district, and what are the obstacles in law enforcements against gold mining players without permits, in cerenti sub district. Seen from the type of this research in classified into observational research, by survey, it means seeing the symptoms or phenomena that occur in the field, namely how efforts in law enforcements against, unlicensed gold mining actor in the polsek cerenti district. Descriptive research mean that a study is a carried out with the main objective of providing an objective descriptions of a situations, which provides as detailed data as possible about law enforcement against unlicensed gold mining, and constrains in law enforcement against unlicensed gold mining players in cerenti sub-district. From the results of research that has been done, it can be seen that the constraints in law enforcement against gold mining players without permission, and efforts in law enforcement against gold mining players without permits in the cerenti sub-district are based on :personnel factors, facilities and infrastructure, community factors, cultural factors, economics factors. While efforts in law enforcement against unlicensed gold mining operators are carried out in the following ways : conducting raids, arrests, burning, dissemination, and non reasoning efforts, preventive and refresif measures, in non-reasoning efforts by conducting counselling, socializations, while by way of refresher, namely by enforcing the law against gold mining players without permission
