Abstract

Registration of the transfer of land rights due to sale and purchase is regulated by government in Indonesian regulation no. 24 of 1997 which states that the transfer of ownership rights through buying and selling must be carried out by PPAT but in reality the case of the Bangko regency, Rokan Hilir regency is generally not carried out before PPAT. This research was conducted to answer the problems regarding the implementation of the registration of the transfer of land rights due to buying and selling and things that hampered it in Bangko sub districk, Rokan Hilir regency. This type of research is observational research. In this study the authors obtained information from respondents, namely the people who bought and sold land, the village head, and the head of the land law relationship section by distributing questionnaires and interviews directly. The writer uses descriptive analysis with inductive conclusion method. Based on the research, it can be concluded that : (1) the registration of the transfer of ownership rights over land due to buying and selling in bangko sub district has been running quite well but has not been carried out maximally because the community does not understand the importance of registering the transfer of rights to the land, other than officials of the land agency are not keen to provide legal counselling or provide the understanding that the importance of registering the transfer of ownership rights to the land is mainly due to buying and selling. (2) barriers encountered in the implementation of the registration of land rights due to buying and selling can be derived from internal factors fom the land agencys office because of the lack of requirements submitted by the applicant to register the rights to the land office which caused the length of process registration of the land transfer and seems complicated which requires the applicant to go back and forth to the land office, while the external obstacle of the community itself is the amount of costs that must be incurred by the community for registration of ownership rights in addition to complicated procedures.
