Abstract

In today's modern era, human life is never separated from the development of technology in all its activities. The development of information and communication technology has an impact on very fast changes in various fields of human life, including the economic field. This means that technology in the economic field causes the emergence of innovation and order for new parties in the development of the economic world. One of the innovations in the world of economy that is touched by technology is the financial sector. Innovation in the financial sector with a touch of technology has given birth to technology in financial services called Financial Technology. The existence of a new party in the implementation of payment transaction processing has an impact on the development of infrastructure and payment mechanisms. Based on the background above, the authors are interested in conducting research on this matter by taking the main problem, namely how the mechanism is carried out by GO-JEK to be able to carry out payment transactions with GOPAY payment services, and how is the responsibility of GO-JEK. In the event that the consumer suffers a loss related to the balance of GO-PAY based on Law no. 8 of 1999 concerning Consumer Protection. The research method used in this research is Normative Empirical research. Empirical Normative is legal research regarding the application of normative legal provisions (codification, laws or contracts) in action on every particular legal event that occurs in society. The results of this study indicate that in the mechanism established by Bank Indonesia there are steps that must be carried out by business actors to be able to carry out technology-based payment transaction activities, namely registration of financial technology providers, testing in the Regulatory Sandbox, and licensing and approval from Bank Indonesia. In carrying out payment system service activities, the operator is obliged to apply the principle of consumer protection. The application of consumer protection principles carried out by GOJEK as GO-PAY operator has not been fully in accordance with the applicable laws and regulations. Regarding liability, GO-JEK is only responsible for losses that are directly caused by GO-JEK. GO-JEK is not responsible for losses caused by parties other than GO-JEK, but GO-JEK has a complaint service for consumers who are harmed and will help these consumers.
