Abstract

The intensity of development continues to increase, while the available land supply is increasingly limited. So that it is increasingly difficult to obtain land to carry out development, especially development for the public interest. So it is necessary to procure land for the development of the public interest. The construction of the Dorak Ring Road in Meranti Islands Regency is for the public interest, so that the land around the residential area must be released first through the release of rights for the needs of the 24x2,400 = 57,600M2 Road Project. Development for the Public Interest is issued through the Decree of the Governor of Riau Number: KPTS.555 / VIII / 2014 and Decree of the Kepulauan Meranti District Number: 127 / HK / KPTS / XI / 2014 for approval of location determination. In the construction of the Dorak Ring Road, the Kepulauan Meranti District delegated land acquisition activities to the Executing Team for Land Acquisition including compensation costs charged to the Meranti Islands Regional Budget with a mechanism regulated in Law Number 2 of 2012 and Presidential Regulation Number 71 of 2012 concerning Land Acquisition For Development in the Public Interest. From the results of observations, interviews and data collection on the object of research in Tebing Tinggi Subdistrict, Meranti Islands Regency, the formulation of the problem is: (1) What is the process of implementing the release of land rights for the development of the dorak ring road in Kepulauan Meranti Regency? ; (2) What are the obstacles that arise against compensation for land acquisition for the construction of a ring road? The results of this study indicate that (1) in the process of implementing the release of land rights in the Tajung Mayat Village and Banglas Village, namely by means of deliberations that were repeatedly carried out to reach an agreement. For the community whose land is disputed, the resolver must be carried out first by the competent authority to resolve the dispute and then the compensation price will be set according to the land boundary of each party receiving the compensation, then the community will not mediate the compensation. persuasive by the objection study team held a deliberation again and gave an understanding of the benefits in this development so that the solution was not necessary through the court's green desk. Whereas for the residents concerned there is no place / present the family can be represented in the place to obtain information from the committee. And (2) The Constraints Occurred Against Compensation for Land Procurement for the Construction of the Dorak Ring Road, Unknown land ownership limitations, not yet strong land status in the eyes of the Law, Occurrence of Inheritance Processes, landowners not in place, Lack of District Government Budget.
