Abstract

The Sale and Purchase Binding Agreement (PPJB) is a preliminary agreement, the purpose of which is to bind the parties first to facilitate the buying and selling activities of the house and provide legal certainty for the seller and the buyer because there are requirements that have not been fulfilled to make a deed of sale and purchase. With the issuance of PERMEN PUPR Number 11/PRT/M/2019 concerning the Preliminary Sale and Purchase Agreement System, it is here to provide a sense of security for consumers and provide a fair impact for both parties who are in the process of binding the sale and purchase of houses. The main problem in this research is how to carry out the sale and purchase of houses according to Ministerial Regulation No. 11/PRT/M/2019 concerning the binding sale and purchase agreement at the Puri Mega Sejahterah Housing and how is the legal certainty of the binding agreement for the sale and purchase of houses at the Puri Mega Sejahterah housing complex. The research method that the author uses in writing this thesis uses a type of legal research using observational research methods which are carried out by direct research conducted at the research location using data collection tools in the form of direct interviews. While this research is descriptive, the researcher tries to share a detailed description of the implementation of buying and selling houses according to Ministerial Regulation No.11/PRT/M/2019 concerning PPJB in Puri Mega Sejahterah Housing. Based on the results of the study, it is known that in the implementation of buying and selling houses according to Ministerial Regulation No.11/PRT/M/2019 concerning PPJB in Puri Mega Sejahterah Housing has not gone well, as with the implementation of PPJB, developers who do not make PPJB before a Notary in the form of an authentic deed , but executed in the form of an underhand deed, so that this agreement is not yet strong in the eyes of the law and the emergence of unwanted things or problems in the agreement if one of the parties will violate the agreement. The legal force of binding the sale and purchase contract (PPJB) of the right to a house/residence made by a notary and received during the execution of the sale and purchase binding contract has the highest legal force, so that this contract becomes a notarial deed. It is an authentic deed that binds both parties and has full evidentiary value. The legal force in Puri Mega Sejahterah Housing is still weak, because it only establishes a bond between the buyer and the developer without being before a notary, then this agreement can be null and void by law. good and right.
