Abstract

Gorilla Tobacco is a new type of Narcotics that has not been entered into Law No. 35 of 2009, this type of plant is currently widely consumed and sold in various countries including Indonesia. The impact of gorilla tobacco is very dangerous for the human body. Until now the spread of narcotics and drugs has reached a very alarming level. In Indonesia, drugs were initially a small problem and the New Order Government existed at the time that drug problems could not develop because they saw the basis of Indonesia, namely Pancasila and Religion, various efforts had been made to prevent and overcome the dangers of drugs that had damaged the younger generation. But the development is increasingly rapid, plus the entry of new types of drugs Gorilla Tobacco which began to have an effect and very widespread in the midst of society. And now the Government has put gorilla tobacco into the Narcotics Category I category through the issuance of Permenkes No. 2 of 2017 so that users can be subject to criminal penalties. The main problem in this study is how is the regulation on Narcotics in Law No. 35 of 2009 and how is the development of gorilla tobacco in Indonesia. The method carried out by this study is a normative juridical research method where normative juridical legal research is obtained from library data sources with the type of data in the form of secondary data. Normative legal research is a process to find a rule of law, legal principles and legal doctrines to answer the legal issues at hand. From the results of the study, it can be seen that the proliferation of narcotics circulation and development because Law No. 35 of 2009 is considered no longer able to keep up with the times and cannot reach all types of narcotics, considering that the development of narcotics is increasingly prevalent. can adjust the development of the times so that the rules made can be run by law enforcers properly so that it can provide a bright effect for the users and pengedaeda Narcotics. After the issuance of Minister of Health Regulation No. 2 of 2017 gorilla tobacco into the category of Narcotics Group I was only a legal basis to ensnare narcotics traffickers and users even though it was rather late considering the very rapid development and young people found, the impact of gorilla tobacco use had a very large effect for gorilla tobacco users to make someone like gorilla craving and unable to move his body other than that it can also cause someone to experience a neurological disorder commonly called tremor, the need for cooperation from all parties to overcome the circulation of gorilla tobacco in Indonesia.
