Abstract

over the world, the problem of refugees has become a contemporary issue that requires special attention from the international community, in this study, many refugees from Afghanistan. The reason why this study chose Afghan refugees is because quantitatively Afghan refugees are the largest refugees in the world. The Pekanbaru City Immigration Detention House (Rudenim) has noted that there have been 1,176 refugees and asylum seekers from abroad recorded as accommodating in the local area. Most of them are Afghan citizens, so this study aims to determine the Role and Responsibility of Pekanbaru City Government in Helping and Overcoming Problems of Refugees Victims of War Conflict Viewed Based on the Refugee Convention in 1951. The type of legal research used in this study is normative legal research that focuses on norms positive law. The nature of the research in this thesis uses descriptive analysis method, which is a method that intends to provide an overview based on the data collected along with the analysis supported by primary data obtained from field research. The method of drawing conclusions in this study is to draw a conclusion deductively, which is to draw conclusions from things that are general to things that are specific. In general, the results of the study explained that the Role and Responsibility of Pekanbaru City Government Against War Victims Refugees Viewed From the 1951 Convention stipulated in the Director General of Immigration Regulation regarding the handling of illegal immigrants who claim to be asylum seekers has been carried out well because all regulations from the director general of immigration were implemented but there are still some policies which according to the author must be reconsidered. Considerations regarding policies allow asylum seekers to leave the Immigration Detention Center without escort. The efforts of the Pekanbaru City Government in carrying out its program in resolving the problem of refugees in transit in Pekanbaru were reviewed based on the 1951 Refugee Convention, namely: 1) Involving UNHCR with refugees and asylum seekers. Indonesia is one of the countries that has not been a member of the 1951 Refugee Convention or the 1967 Protocol and also does not have a mechanism for determining refugee status; 2) Promoting the application of refugee law. UNHCR supports the development of a national framework to assist the Indonesian government in dealing with the arrival of people seeking protection; 3) UNHCR carries out its mandate regarding citizens without citizenship in Indonesia.
