Abstract

Marriage is the inner bond between male and female to build a sakinnah, mawaddah, and warahmah marriage, and each marriage have their own problem it is not fluent as it seem, because of the difficulity to combine the diversity that caused divorce. Based on those explanation, the main problem of this research are; what is the biggest factors that caused and how to resolve The High Rate of Divorce in Jurisdiction Court of Pekanbaru. Method of this research viewed from types and the character, then this research belonged to empirical research method, which is directly lead to problems occured. The source of data is taken from primary and secondary data, data collection technique of this research is using questionnaire and intervie, to the descriptive respondents researcher explain clearly and detail about The High Rate of Divorce in Jurisdiction Court of Pekanbaru. The population of this research is participant of divorce, judge, elerk of a court and the chairman of Indonesian Ulama Council of Pekanbaru. The High Rate of Divorce in Jurisdiction Court of Pekanbaru caused by some factors. One of those factors is economical factor with percentage 38.9%. it is because husband can not fulfill family’s needs. The second factor is presence of domestic violence with percentage 11.11%, physically and mentally injury done by husband to wife. The third factor is affair with percentage 22.22%. the fourth factors is the presence of third person in the household with percentage 27.7% The way to overcome The High Rate of Divorce in Jurisdiction Court of Pekanbaru begin with the role of judges to reconcile the divorce through meditation. Next from Indonesian Ulama Council of Pekanbaru to provide the way to overcome of divorce by provided bride candidates through counseling before marriage, strengthen the faith and moral improvement in order ro avoid the affair and enhance the role of BP4 as an agency that provide the consideration and help to solve the household problems before submitted to religious court.
