Abstract
ndigenous Law Society (MHA) with its various existences has given serious views in various studies and acknowledgments. This is all clearly seen in the view of experts, legislation, and the indigenous people themselves regarding the recognition of the MHA. But all that has not been able to provide a definite answer to its legitimacy as a subject with all the rights of its community. Perspective and parameters that are not always the same also lead to ambiguity in the concept of MHA and communal rights in concrete situations in the midst of society. This study focused on the views of experts and legislation and indigenous peoples towards MHA. Then also provide answers to the terms, steps and / or processes that must be fulfilled in providing legal legitimacy and certainty for MHA with all communal rights and in the end there is an answer to the problems so far as the cause of MHA and its communal rights that do not provide legitimate status with all forms of legal consequences
