Abstract

Criminal acts of fraud for Prospective Civil Servants are increasingly common, both in remote areas and in urban areas. This is because many people think that a job as a Civil Servant is a job that is safe and guarantees old age. The main formulation in this study is how the basis for judges' considerations in sentencing criminals against perpetrators of fraud related to the acceptance of prospective civil servants in case number 1223/Pid.B/2019/PN Pbr and the Pekanbaru District Court judge's decision against perpetrators of fraud Relating to the Acceptance of Prospective Civil Servants in the Decision on Case Number 1223/Pid.B/2019/PN Pbr Has Fulfilled a Substantive Sense of Justice. This type of research method and the nature of the research is observational research, is descriptive in nature, provides an explanation through a study of applicable legal provisions and what happens in the reality of society. Empirical research uses legal materials consisting of primary data, namely data obtained directly from sources in the field and secondary data, namely data obtained from library materials which are divided into primary legal materials, secondary legal materials. This research was conducted at the Pekanbaru District Court and the respondent, namely from the Panel of Judges who decided case number: 1223/Pid.B/2019/PN Pbr. Based on the results of research on the Crime of Fraud for Prospective Civil Servants in the Legal Area of the Pekanbaru District Court, injustice occurred in the case decision process by the Pekanbaru District Court Panel of Judges which caused substantive injustice against the defendant in decision number: 1223/Pid.B/2019/PN Pbr.
