Abstract
This Research observ the author regarding a gold mortgage Pegadaian at Pekanbaru city pawnshop with all the problems and threats made by creditors. According to the title, the authors research location is the State-Owned Enterprise (BUMN) PT. Pegadaian Pekanbaru City. PT. Pegadaian is one of the nonbank financial institutions that offers financing for precious metals (gold) on easy and efficient terms in accordance with its motto �Resolve Problems Without Problems. Gold becomes a collateral that is kept by PT. Pegadaian. The implementation of the credit at PT. Pegadaian has constraints that make the custome unable to pay installments until repayment, in other words the occurance of a default (Wanprestatie), if a customers default can lead to a dispute between the two parties so that the settlement must be agreed upon by the parties. From the background above, the problem that the authors examine is how to guarantee gold pawn at Pegadaian Pekanbaru City and how the position of gold pawn collateral is because customers default on Pegadaian Pekanbaru City. Of course the author here looks at how the implementation and completion if there is a default and the position of the mortgage guarantee object. In this study the type of research used is observational research by the survey, with the sampling methods is purposive sampling that is sampling that is only adjusted to the purpose of the study, so that the purpose and objectives of this research are achieved. As for the population in this study were 1 Pegadaian leader, and 23 Creditors (customers) from the Pegadaian themselves. From this study, it can be seen that the guarantee of gold pawn at PT. Pegadaian Pekanbaru City offers precious metal (gold) credit with an easy and efficient process, while the requirments offered by PT. Pegadaian are first customers have or have a identity card and both customers pay an advance determined by PT. Pegadaian. The causes of default occur between customers and PT. Pegadaian include family factors, business factors, and market competition and the allocation of loan funds from the Pegadaian. This default occurs because of a lack of in depth analysis of prospective customers resulting in default. From this study it can be concluded the guarantee of gold pawning at Pegadaian Pekanbaru City Pegadaian in its completion prioritizes the process of deliberation and consensus first, but if it does not find a point of agreement between the two parties then regarding the legal relationship and the mortgage agreement refer to the Civil Code Law or other rules governing the mortgage agreement.
