Abstract

Islamic inheritance law is a rule that regulates the transfer of estate from a deceased person to a deceased relative, a rule that regulates who gets estate and how much estate is earned according to Shari'at Islam. This research discussed the implementation of Islamic inheritance law in the Banjar society in Tembilahan District, Indragiri Hilir Regency. The Banjar society is a majority society that adheres to Islam in Tembilahan Subdistrict. Although the majority of the Banjar society is muslim, the implementation of Islamic law based on Shari'ah provisions is still difficult to find. Specifically, this study aimed to find out the extent of the implementation of Islamic inheritance and anything that becomed an obstacle to the implementation of Islamic inheritance law. This research was a type of field research (observation) and its nature was descriptive analysis. This study conducted in interviews with religious leaders, urban village heads and direct interviews with the banjar society who have been heirs. This study used a sociological legal approach that was direct field research. For data collection obtained from observation and interview. The results showed that the implementation of Islamic inheritance in the Banjar society in Tembilahan Subdistrict, Indragiri Hilir Regency was not optimal. The reason was because of the lack of a deep understanding of the Islamic inheritance jurisprudence. And the society with its lack of understanding assumed that Islamic inheritance is not a compulsory thing to do.
