Abstract

gambling is a real or potential threat to social norms so that it can disrupt public activity. Thus gambling can damage the morale of someone who does this. Therefore gambling must be dealt with in a decisive manner so that it can have a 12 deterrent effect for the gamblers. the binding of gambling is contrary to religion, morality and Pancasila morality. One such firm effort is the criminal law enforcement policy approach. This happened at the custom of the talang mamak tribe in the village of Talang Jerinjing, Indragiri Hulu Regency, where in each event the customs always played gambling as one of the conditions for the commencement of the customs. The problem in this research is how the regulation of gambling according to the criminal law (KUHP) in a legal case about gambling is done by the mamak gutter tribe in Talang Jerinjing village in the jurisdiction of the Selasih Hill Polishing and what is the role of law enforcement in following up gambling crimes committed by the Talang Mamak tribe in Talang Jerinjing village in the jurisdiction of the Selasih Hill Police Station. The research method used is Research Observation, namely by survey. While the nature of this research is classified as descriptive research, namely research that aims to provide a clear detailed description of gambling carried out by the mamak gutter tribe in the village of Talang Jerinjing, Indragiri Hulu Regency and what is the role of law enforcement in following up gambling crimes committed by the Talang tribe Mamak in Talang Jerinjing village in the jurisdiction of the Buki Selasih police station. Talang Mamak tribe is the oldest tribe in Talang Jerinjing village, and has very strong customs. Like employees (marriage, circumcision, and burial), and in the event these customs contain positive values such as gaining new knowledge of these customs, and negative values such as cockfighting gambling while the customs process takes place. Rules for implementing criminal acts of gambling Talk about "Gambling" including "Cockfighting" which is better known as tajen than prohibited by Religion, is also expressly prohibited by positive law (KUHP). This can be seen from the provisions of article 303 of the Criminal Code, Jo. Law No.7 of 1974 concerning Gambling Control Jo. PP. No. 9 of 1981 Jo. Presidential Instruction and Minister of Home Affairs Instruction No.5, April 1, 1981. And the role of law enforcers in following up gambling crimes committed by the mamak gutters in Jalang Jerinjing village by conducting a socialization to the Talang Mamak tribe community that gambling violates the law and can be sanctioned if violated.
