Abstract
ABSTRACT Good faith is one of the principles of the agreement, which is located in Article 1338 Paragraph (3) of the Civil Code, which explains that the agreement must be made in good faith. The stroller rental business in Pekanbaru is the Pekanbaru Baby & Kids Kartama Stroller Rental, which if someone wants to rent a stroller must sign an agreement, where the contents of the agreement are the time of renting goods, the leased product is not allowed to change hands to the other party, the provisions of damage to the stroller , and provisions for the loss of the stroller. In fact, there are still many consumers who have signed the agreement but still violate the contents of the agreement, it is clear that they do not apply good faith in implementing the agreement. The main problem in this research is how to apply the principle of good faith in the stroller rental agreement at the Pekanbaru baby & kids kartama stroller rental, and what are the obstacles in implementing the principle of good faith in the stroller rental agreement at the Pekanbaru baby & kids kartama stroller rental. The purpose of this research is to find out how to apply the principle of good faith in the stroller rental agreement at the baby & kids kartama stroller rental Pekanbaru and what are the obstacles in the application of the principle of good faith in the stroller rental agreement. The method used in this research is empirical law (observational research), which is research carried out directly to the place of the research object, to obtain data related to the application of the principles of good faith in the stroller rental agreement at the baby & kids kartama rental in Pekanbaru. . The application of the principle of good faith in the stroller rental agreement at the Pekanbaru baby & kids kartama stroller rental should apply the principle of good faith, because there are still many tenants who do not carry out the obligations contained in the contents of the agreement, namely the tenant must be on time in returning the stroller, not transferring the stroller and do not damage the stroller and do not lose the leased stroller. Constraints in implementing the principle of good faith in the stroller rental agreement at the Pekanbaru baby & kids kartama stroller rental are that the tenant lacks good intentions in carrying out the contents of the agreement, namely compensating for damage and loss of the rented stroller.
