Abstract

ABSTRACK In civil law the third book discusses engagements or agreements "agreement according to article 1313 of the civil code is an act where one or more people bind themselves to one or more other people" by which the parties carry rights and obligations and also each party is obliged to do something or not do something. This explains that the agreement has been regulated in the Civil Code starting from the legal terms of the agreement and understanding or other arrangements of whatever is included in the agreement, in this case the agreement also has the principles contained therein, with the principle of is expected to be the basis for thinking in the agreement, generally the terms and principles are indeed used in the agreement to serve as the basis for an agreement such as the principle of good faith needed in society. The main problem in this research is how to realize the principle of good faith in Deed No. 28/2018 and what are the obstacles to implementing good faith in Deed No. 28/2018 The research method used is sociological legal research, namely research with field data as the main data source, such as the results of interviews and observations, observations made are by means of surveys, or in other words, a research conducted on real conditions that occur. in the community with the intention of knowing and finding the facts of the data needed, after the data is collected, the problem will be identified with the aim of solving the problem The results of this study are that the implementation of the agreement in Deed No. 28/2018 which contains the land sale and purchase agreement is reviewed in its implementation based on the principle of good faith, where the parties carry out the agreement in good faith through deliberation and consensus, the obstacles faced by Mr. Ahmad Rinaldi is a declining situation because Indonesia was hit by covid at that time so it also affected Mr. Ahmad Rinaldi's finances in carrying out payment obligations that he had to fulfill, with an explanation of using the money for other purposes, and also the lack of open communication for the parties.
