Abstract

Cooperatives are a form of effort to prosper the people in terms of the economy, various efforts are made to achieve these goals, the Pekanbaru Rejosari Cooperative which is a multi-purpose cooperative in which there is a cooperative effort in improving the welfare of its members called savings and loans, as a result problems arise related to loan agreements between the cooperative and its members as debtors, which is called default, therefore on this occasion the author has the opportunity to conduct a thesis research with the title "Law of Default in a Savings and Loan Agreement at a Multipurpose Cooperative Rejosari Pekabaru City". The formulation of the problem in this study is as follows: 1. What is the form of default in the loan agreement at the Rejosari Multipurpose Cooperative ?, and 2. How is the settlement of the default dispute in the savings and loan agreement at the Rejosari Multipurpose Cooperative ? The research method used is an observational research type which is seen from its descriptive analytical nature whose data uses primary data as the main data, that is, it goes directly to respondents to conduct interviews and uses secondary data as data to support the main issues to be discussed. Analysis of the data obtained by means of a qualitative descriptive which the researcher will later relate to the theory and also the laws and regulations that are in accordance with the formulation of the research problem. The form of default in the Loan and Loan Agreement at the Rejosari Multipurpose Cooperative is first, the debtor does not meet achievement at all, then the second is the debtor meets achievement, but is not good or wrong, and the third is fulfilling achievement but not on time. Settlement of Default Disputes in the Savings and Loan Agreement at the Rejosari Multipurpose Cooperative, the first is Monitoring or Supervision, then rescheduling, Reconditioning, and the last resort is restructuring.
