Abstract

An underhand agreement is a form of agreement made by the village unit cooperative as business activity in the form of savings and loans, one of wichh is a loan in the form of fertilizer. This is followed by the submission of receipts as a means of paying monthly instalments as well as evidence of credit in the event of a breach of promise or default by the debtor, this is in accordance with Article 1867 of the civil code. The main problem in this research is how to implement legal protection for creditors in an underhand agreement in the cooperative vilge unit of BAKTI warga, and how efforts can be taken if there is a default in the agreement under the hand in the cooperative Unit desa Bakti warga.. The research method used in this research is research: observational research, which is carried out by means of a survey, namely by direct research to the research location at the Village unit Coperative (KUD) Bakti warga Bukit sari Intan Jaya by obtaining data in the form of interviews and questionaires. And this research is descriptive, wich provides a clear and detailed description of the main problem being studied. The legal protection of creditors in the event of default with proof of receipts as a means of payment has not been realized as it should be, where the debtor does not want to be responsible for this loan and remains negligent to pay his obligations in accordance with what was previously agreed. The steps that can be taken by the Bakti warga Village unit Cooperative in this case are in the form of charging interest rates.
