Abstract

Parking services are one type of business that is often profitable and needed by many people. This has become commonplace for the community because seen from transportation which is increasingly developing to encourage a company or institution to make a parking lot business. With the existence of parking service facilities, people often entrust the security of their private vehicles to the parking manager to be guarded. However, in the field incident it was found that consumers often feel disadvantaged by parking businesses if the vehicle that is deposited is lost. In cases like this, the parking manager often refers to the standard clause in the parking agreement, namely the transfer of responsibility which states that he is not responsible for the loss of the vehicle parked at that place. Based on Article 1 point (1) of Law Number 8 of 1999 concerning Consumer Protection, consumer protection is all efforts that guarantee legal certainty to provide protection to consumers. Consumers have a number of legal rights that need to be protected in their fulfillment. These rights should receive understanding and appreciation from all parties in the life of the nation and state. The formulation of the problem in this study is what form of legal protection is the determination of standard clauses for parking services for vehicle loss at the Kaharudin Nasution Rumbai Satdion? And what are the obstacles in carrying out the legal protection of determining the standard clause for parking services for lost vehicles at the Kaharudin Nasution Rumbai Stadium? This type of research is empirical legal research. Empirical Legal Research is a legal research method that uses empirical facts taken from human behavior. The data of this study were obtained through an interview process with 2 parking attendants and 15 people who had experienced the loss of a motorbike at the Kaharuddin Nasution Rumbai Stadium as well as by observation and documentation. The data obtained from the results of data collection, then arranged systematically in order to obtain a comprehensive picture of legal principles, legal rules, and legal provisions and then analyzed qualitatively. The results obtained are that the parking manager is responsible for providing compensation to consumers whose vehicles are lost in the parking area managed by Kaharudin Nasution Rumbai Stadium as the parking manager. Because the parking manager is proven to have violated the law in the parking agreement which is an agreement for the safekeeping of goods, with his lack of caution and negligence, the vehicle belonging to the consumer has been lost. legal protection for the determination of standard clauses for parking services for lost vehicles at the Kaharudin Nasution Stadium. Obstacles in carrying out the legal protection of setting a standard clause for parking services for lost vehicles at the Kaharudin Nasution Rumbai Stadium, most vehicle owners prefer to report complaints to the police station rather than follow the existing SOPs in the parking sector.
