Abstract

One of the production practices that has received a lot of attention from practitioners in the field of occupational safety and health at PTPN V Sei Pagar, is none other than the many sources of danger that can result in accidents or occupational diseases. The formulation of the problem that the author examines is how to implement the legal protection of occupational safety and health for workers at PTPN V SEI PAGAR based on Law No. 1 of 1970 concerning occupational safety and what are the obstacles to the implementation of legal protection of occupational safety and health at PTPN V SEI PAGAR based on Law no. 1 of 1970 concerning Work Safety. The type and nature of the research carried out by the author is a type of legal observational research (observational research), that is, researchers go directly to the field to obtain research data. While the nature of this research is descriptive analytical, namely describing or providing an overview of the data obtained from the field, namely about the protection of Occupational Safety and Health of Workers at PTPN V SEI PAGAR Based on Law No. 1 of 1970 concerning Occupational Safety. The results and discussion of this research is that in the implementation of legal protection at PTPN V SEI PAGAR there are obstacles caused by workers who do not use personal protective equipment, they argue that they rarely use safety equipment because they are not used to it and are uncomfortable when using PPE which they usually use is gloves and masks only, where the level of legal awareness of the company is still too minimal in implementing SMK3/K3 not in accordance with Law no. 1 of 1970 on work safety and no. 13 of 2003 concerning employment, it is proven that there are workers who do not apply the occupational safety and health management system (SMK3).
