Abstract
The illegal or black market cellphone trade in the Bengkalis Police area is a legal problem that violates the enactment of Law Number 17 of 2006 concerning Customs and the Consumer Protection Law No. 8 of 1999 and the Criminal Code have yet to find a solution, so there is still a need for firmer law enforcement and the effectiveness of law enforcement related to the rampant crime of trafficking in cellular telephones / cellphones. This criminal act of trafficking in cell phones has been investigated and investigated by the Bengkalis Police, by guiding the perpetrator for violating Article 62 Paragraph (1) Jo Article 8 Paragraph (1) letters (i) and (j) Law of the Republic of Indonesia Number 8 of 1999 concerning Consumer protection and / or Article 104 Law of the Republic of Indonesia Number 7 of 2014 concerning Trade or Article 52 in conjunction with Article 32 paragraph (1) of Law No. 36 of 1999 concerning Telecommunications in conjunction with Article 55 Paragraph (1) of the 1st Criminal Code. The author determines the main problem, namely How is Law Enforcement Against Couriers in Illegal Mobile Trafficking in the Bengkalis Police Legal Area and What Are the Obstacles and Constraints in Law Enforcement Against Illegal Mobile Trading Couriers in the Legal Area of the Bengkalis Police. In writing this thesis using observational research legal research methods, namely direct research to the research location using a data collection tool in the form of interviews. Meanwhile, if viewed from its nature, this writing is descriptive analytical, which means that the research is intended to provide a detailed, clear and systematic description. Law Enforcement Against Illegal Cellphone Trafficking Couriers in the jurisdiction of the Bengkalis Police is an act or state effort based on its apparatus starting from the activities of investigations, investigations, prosecutions and examinations in court proceedings and the implementation of judges' decisions. In addition, the form of law enforcement carried out by the Bengkalis Police, is by carrying out operations or seeking information directly about anyone associated with the sale of black market cell phones and taking preventive or repressive measures so that criminal acts of trafficking blackout of this cell phone so that it can be tackled as early as possible Obstacles and Constraints in Law Enforcement Against Illegal Mobile Phone Couriers in the Bengkalis Police jurisdiction include law enforcement factors, facilities and facilities as well as community legal culture factors that do not understand and comply with the prohibition on illegal use of Cellular Phones as mandated in the Law. Number 08 of 1999 concerning consumer protection, because there are neglected consumer rights there and this action is also very detrimental to the State from the tax sector.
