Abstract
Trafficking in persons is a problem of widespread concern in Asia and even throughout the world. Trafficking in persons occurs not only in the country of Indonesia, namely inter-island trafficking, but also trafficking in persons outside the country of Indonesia, where there is trafficking in persons to other countries. So seeing this trafficking in persons is really a disturbing crime not only in Indonesia but even to other countries in the world. The problem in this research is how to enforce the law against the criminal act of trafficking in persons in Bangkinang City in case Number: 185/Pid.Sus/2020/PN. BKN. And what are the obstacles to law enforcement against the criminal act of trafficking in persons in Bangkinang City in case Number: 185/Pid.Sus/2020/PN.BKN. This research method is observational research or research using a survey system, namely by means of interviews and direct observations down to the field. The data used in this legal study includes primary data and secondary data. This research is viewed from its descriptive nature, namely the author tries to provide a detailed description of law enforcement against the criminal act of trafficking in persons in Bangkinang City in case Number: 185/Pid.Sus/2020/PN. BKN. The respondents in this study are the prosecutor and the defendant against the criminal act of trafficking in persons in Bangkinang City in case Number: 185/Pid.Sus/2020/PN. BKN. Law enforcement of the criminal act of trafficking in persons in Bangkinang City in case Number: 185/Pid.Sus/2020/PN.BKN in adjudicating cases, judges are more likely to impose imprisonment or fines by using the minimum sanctions imposed in Law Number 21 of 2007 concerning Eradication of Criminal Acts of Persons. Barriers to law enforcement against the criminal act of trafficking in persons in Bangkinang City in case Number: 185/Pid.Sus/2020/PN.BKN, namely: -The Panel of Judges considers the elements in Article 55 paragraph (1) 1 of the Criminal Code to make a panel of judges it is difficult to place a maximum sanction decision on the defendant. -Article 88 of Law Number 35 of 2014 concerning Trafficking in Persons does not regulate the existence of imprisonment and fines with a minimum and maximum limit
