Abstract

ABSTRACT The household should be a safe place for its members because the family is built by husband and wife on the basis of the inner and outer bond between the two. According to article 33 of Law no. 1 of 1974 concerning Marriage that: "Between husband and wife have an obligation to love each other, respect, and provide physical and spiritual assistance to one another" In the city of Pekanbaru, domestic violence often occurs because of the presence of a third person in the family. household. The verdict of the Panel of Judges refers to the purpose of punishment which is not revenge for the defendant's mistakes, but is educational, corrective and preventive in nature with the intention that in the future the defendant can behave well and not repeat his actions. The main problems of this study are: Knowing the forms of neglect of wives in the household based on Law No.23 of 2004 concerning the Elimination of Domestic Violence and the background of the occurrence of neglect of wives in the household based on Law No.23 of 2004 concerning Elimination of Domestic Violence. The type of research used is descriptive analytical research, which provides an overview of the object under study through data or samples collected by the author going directly to the field to find and collect data that will be used as material for writing scientific papers, the data is obtained through questionnaires and Interview. The result of this research is that the occurrence of domestic violence in Pekanbaru city is caused by the presence of a third person in the household relationship, thus triggering conflict between husband and wife which leads to violence perpetrated by husband to wife. Overcoming acts of violence within the family as well as in the household are resolved not only with an integral approach, but the approach of Penal and non-Penal facilities must also be supported by increasing public legal awareness as regulated in Law Number 23 of 2004 concerning the Elimination of Domestic Violence ( PKDRT) Article 5 which states “Everyone is prohibited from committing domestic violence against people within the scope of their household, by: (a) physical violence; (b) psychological violence; (c) sexual violence; or (d) neglect of the household” (Law No.23 of 2004 concerning the Elimination of Domestic Violence).
